Businesses on Thin I.C.E.: Immigration Targets Small Employers for Aggressive*
Description:
When last year’s Congress failed to produce a framework for reform to the immigration system, the administration turned to aggressive enforcement of current immigration laws. The ‘new and approved’ Immigration and Customs Enforcement (I.C.E.) has targeted small employers, particularly in agricultural and manufacturing industries, with heavy enforcement tools not previously used in immigration enforcement. Small business owners are finding themselves charged with federal felonies and facing civil forfeiture proceedings if Immigration discovers that all or part of their work force consists of undocumented immigrants. At the same time, employers are limited in what they can do by anti-discrimination laws and by the prevalence of fraudulent documents. This presentation will introduce employers to some methods and best practices they can use to protect themselves from immigration enforcement, as well as introducing the government’s new tools for assisting employers to remain in compliance with immigration laws. We will also briefly discuss the types of visas available for bringing workers into the United States to fill positions that U.S. workers are not available to fill, including seasonal and peak-load work.
