EMPLOYMENT LAW
FMLA, ADA & Workers’ Compensation: The Fearsome Threesome*♦ - NEW!
Description
The FMLA, the ADA and the Workers’ Compensation laws are three overlapping circles, and where they overlap, they often provide contradictory mandates. If an employee has a “serious health condition” under the FMLA, is he also covered by the ADA? If so, is unpaid leave under the FMLA a sufficient “reasonable accommodation” under the ADA? Suppose the employee’s problem arises from a workplace injury – is he entitled to unpaid leave and additional “reasonable accommodations” beyond what the Workers’ Compensation laws require? The issues are difficult and the stakes high. This seminar will help you get it right.
Topics
  • How the FMLA, ADA and Workers’ Compensation laws do, and do not, overlap
  • When must you provide unpaid leave versus a reasonable accommodation?
  • When must you provide unpaid leave and a reasonable accommodation?
  • What are your ADA and FMLA obligations to employees who suffer workplace-rated conditions?
  • The traps and pitfalls: where they are, and how to avoid them
