Executive Order 11246, creates certain obligations for government contractors and subcontractors. The Executive Order requires that contractors doing business with the federal government institute employment policies consistent with equal employment opportunity and affirmative action for all job applicants and employees regardless of race, color, religion, sex or national origin. There are different levels of obligations for the government contractor/subcontractor, depending on the number of employees in its workforce, and the dollar value of the government contract/subcontract.
Employers who employ 50 or more employees, and have federal contracts or subcontracts greater than $10,000, are required to demonstrate “good faith efforts to undertake and achieve equal representation of minorities and women” in their workforce.
For employers who have 50 or more employees, and have a federal contract or subcontract worth $50,000 or more, there is an additional obligation. They are required to prepare and implement an Affirmative Action Plan (AAP), which must be updated annually.
